Update on AB 2097

Here's where we're at with this bill.

I received some good feedback from people on this list. In addition, I've
received many comments from co-authors, potential co-authors, potential
co-sponsors, and from opposition. Unfortunately, we were unable to submit
substantive amendments in time for the vote on the 18th (due to volume of
bills under consideration, and the fact it needs to go through Legislative
Counsel, we would have had to submit amendments several weeks ago).

Actually, I don't know that this was unfortunate. It's understood that the
bill will be amended as we go along (probably several times). Interested
parties seem to have gotten the gist of the bill just fine, and the concern
about grandfathering (picked up by Ron Crane and David Jefferson) has not
been an issue. People seem to agree that it is intended to apply to
certified systems, whether certified before or after the bill takes effect.

We were able to get minor amendments through -- these only took out a couple
of things Legislative Counsel had thrown in there for some reason ("shall"
changed to "should" put back to "shall," and the urgency clause was

So it's up for a vote on the 18th pretty much as originally drafted. We
expect the committee chair to vote against it (with the Republicans) as he
did with the clean money bill (AB 583). We need the other 4 votes
(Democrats, Leno, Karnette, Klehs, and Levine) to pass. Leno is now a
co-author, and we're working on the other three.
